First Assistant Prosecutor James P. McClain
First Assistant Prosecutor James P. McClain supervises various litigation and investigative functions within the office.
Mr. McClain also is in charge of the legal staff and is responsible, with the approval of the Prosecutor, for the hiring, firing, discipline and transfers of assistant prosecutors within different sections of the office.
He also oversees the investigation and litigation of all cases of official misconduct and public corruption within the office.
Mr. McClain received his B.A. degree in History from LaSalle College in Philadelphia in 1979 and he received his law degree from Rutgers University School of Law in Newark in 1982.
Following his graduation from law school, Mr. McClain served as a judicial clerk for the Honorable Joseph M. Thuring in the Criminal Division of the Superior Court in Hudson County, New Jersey. Following his admission to the New Jersey Bar in 1983, he was hired as an Assistant Prosecutor by the Atlantic County Prosecutor's Office and assigned to the Appellate Section. From 1984 to 1986 he was assigned to try cases, first as a member, and then as a leader, of a trial team. From 1987 to 1992 he was assigned to the investigations division.
In 1993, Mr. McClain was promoted to the position of Chief Assistant Prosecutor, and from that time until his appointment as First Assistant on October 1, 2010, he supervised the investigation of, and tried cases dealing with, public and police corruption, white collar crime, the sexual and physical abuse of children, vehicular homicide and assault, bias crimes and environmental crimes. He has also argued appeals before the Appellate Division and the New Jersey Supreme Court.
Since 1996, Mr. McClain has been recognized as a Certified Criminal Trial Attorney by the Supreme Court of New Jersey.
